Terms of Service

These Terms govern access to and use of Sendout and establish customer responsibilities for lawful, permission-based email sending.

1. Agreement

By creating an account, using API or SMTP credentials, configuring a sending domain, or otherwise using Sendout, you agree to these Terms and the policies incorporated by reference, including the Acceptable Use Policy, Anti-Spam Policy, Sender Requirements, and Privacy Policy.

2. Service

Sendout provides email infrastructure and developer tools for sending and observing legitimate application-generated email. Features may include APIs, SMTP access, domain verification, delivery events, suppression, logs, and sender controls.

3. Account and credential responsibility

You are responsible for activity performed with your account, API keys, SMTP credentials, domains, applications, and integrations. You must maintain accurate account information, protect credentials, rotate exposed secrets, and promptly notify Sendout of suspected compromise.

4. Permission-based sending

You may only send messages that are lawful and that recipients reasonably expect to receive. You must be able to explain how recipients were obtained and why they should expect the message.

5. Prohibited activity

  • Spam, phishing, fraud, malware, deceptive content, or impersonation.
  • Cold email or unsolicited bulk outreach.
  • Purchased, rented, scraped, harvested, guessed, or unlawfully obtained recipient lists.
  • Attempts to bypass suppression, rate limits, sender verification, abuse monitoring, or platform safeguards.
  • Sending from identities or domains you do not control or are not authorized to use.
  • Activity that violates applicable law, third-party rights, or recipient privacy.

6. Sender verification

Sendout may require domain verification, authentication records, account review, business information, use-case details, or other evidence before enabling or increasing production sending. Sendout may refuse or limit sending when verification is incomplete.

7. Bounces, complaints, and suppression

You must maintain valid recipient data and act on bounce and complaint signals. Hard-bounce and complaint recipients may be automatically suppressed. You must not intentionally bypass suppression or repeatedly attempt delivery to recipients known to be invalid or unwilling to receive mail.

8. Unsubscribe and preferences

Where messages are promotional, subscription-based, or otherwise subject to opt-out requirements, you must provide an appropriate unsubscribe mechanism and honor requests promptly. Transactional messages must remain limited to the service or account purpose that caused the message to be sent.

9. Monitoring and enforcement

Sendout may monitor delivery, bounce, complaint, abuse, security, and usage signals. We may rate-limit, reduce quotas, pause sending, require remediation, suspend credentials, or terminate accounts when reasonably necessary to protect recipients, infrastructure, reputation, or other customers.

10. Customer content and data

You retain responsibility for your email content, recipient data, sender identity, legal basis, and compliance obligations. You authorize Sendout and its service providers to process data as necessary to provide, secure, troubleshoot, and support the service.

11. Service availability

Sendout aims to provide reliable service but does not guarantee uninterrupted availability unless a separate written service-level agreement expressly states otherwise.

12. Changes

We may update these Terms and related policies. Material changes will be reflected by an updated effective date and, where appropriate, notice through the service or registered contact information.
